You may not use wealthup.me if you are barred from receiving services under the laws of the applicable jurisdiction, if we previously banned your account for violation of these Conditions of Use, or if you are under the age of 18, if you are below the age of 18, it is presumed that wealthup.me services are monitored and permitted to use by your natural/legal guardian.

b) By using the wealthup.me and wealthup.me Services, you agree that you have read and understood these Conditions of Use and you agree to be bound by these terms and use the services in compliance with these Conditions of Use. If you do not agree to be bound by (or cannot comply with) any of the terms below, please leave wealthup.me immediately and terminate your account with us. The information that you obtain or receive from wealthup.me, its team, contractors, partners, sponsors, advertisers or otherwise on its Website or Platform is for informational and scheduling purposes only.

c) You agree not to use wealthup.me in a fraudulent, disruptive, aggressive, manipulative, for money laundering, or any other inappropriate matter. wealthup.me reserves the right, but has no obligation, to investigate your use of the service for compliance with appropriate use and terminate your access to the Service, or in order to comply with law, regulation, legal process or government request. We will do our utmost to ensure that availability of the Website/Platform will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the Website/Platform may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction.

a) To use the services of wealthup.me, you must create your personal wealthup.me Account pursuant to which you will be able to use the Services. To use the Platform and for the purposes of creation of wealthup.me Account you may be required to provide information about yourself (such as identification or contact) as part of the registration process for the service, or as part of your continued use of the services. You agree that any registration information you give to us will always be true, accurate, correct, complete and up to date. Any phone number used to register with the wealthup.me or any of the wealthup.me Service needs to be registered in your name.

b) In terms of Information and Technology Act, 2000 read with Information Technology (Intermediary guidelines) Rules, 2011, wealthup.me securely transmits and saves your data including but not limiting to the interactions done by the user on the Platform, the transactions undertaken by the user via wealthup.me including the exchange of short message service, to our secure servers. The same enables wealthup.me to not only serve its users with better offers but also with reminders and notifications for activities more in-line for users’ interests and for making the Platform more user friendly.

c) You must also permit wealthup.me to access to your SMS, contacts, location data, installed applications, and such other device data that wealthup.me may require (from time to time) to provide you better delivery of the Services and enable smooth functioning of the Platform.

d) Without prejudice to Clause 2.a, wealthup.me does not save any payment details and information of its users including Internet Banking Details, Credit/Debit Card details, E-Wallet credentials etc. For the purpose of effecting payments/settlements, user is securely transferred to a registered 3rd party online payment gateway.

e) If you use wealthup.me and its wealthup.me Services, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer and mobile to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the your account area of the Platform. You agree and acknowledge that you will use your account on wealthup.me to purchase products or avail services only for your personal use and not for business/commercial purposes. wealthup.me reserves the right to refuse access to the Website, Platform, terminate accounts, remove or edit content at any time without notice to you.

The personal information / data provided to us by you during the course of usage of wealthup.me will be treated as strictly confidential and in accordance with the Privacy Notice and applicable laws and regulations. If you object to your information being transferred or used, please do not use the Website or the Platform.

a) Information provided by wealthup.me or otherwise obtained from the Website or Platform, or through any media, including social media, will not be used for any unauthorized and unlawful purpose

b) You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by wealthup.me on the Platform, unless you have been specifically allowed to do so in a separate agreement with us; You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services); You agree that you will not reproduce, duplicate, copy, transfer, license, rent, sell, trade or resell the information obtained from the Platform or Website for any purpose whatsoever

c) You agree that you are solely responsible for (and that wealthup.me has no responsibility to you or to any third party for) any breach of your obligations under these Conditions of Use and for the consequences (including any loss or damage which Wealthup.me may suffer) of any such breach

d) You will not impersonate another person, including, without limitation, fellow group member or merchant of wealthup.me

e) You agree to the use of your data in accordance with wealthup.me's Privacy Policy https://www.wealthup.me/privacy

f) All personal and contact information provided by you will be kept confidential by wealthup.me. This includes your personal information given in relation to your account creation and subsequent administration.

g) The Website/Platform or any portion of the Website/Platform (including but not limited to any copyrighted material, trademarks, or other proprietary information) may not be reproduced, duplicated, copied, sold, resold, visited, distributed or otherwise exploited for any commercial purpose without express written consent of wealthup.me and / or its affiliates, as may be applicable.

h) You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Website and/or Platform and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilising wealthup.me's or its affiliates' names or trademarks without the express written consent of wealthup.me and/or its affiliates, as applicable. Any unauthorised use terminates the permission or license granted by wealthup.me and / or its affiliates, as applicable.

i) You agree that you will use the Refer & Win system only to invite genuine users who would find wealthup.me's features useful.

a) On creation of an account on the Platform, you will have the opportunity to use various interactive aspects through which you can communicate with our team and share information (collectively "Posted Information"). It is important that you act responsibly when providing such Posted Information. Do not use inappropriate language, make gratuitous personal criticisms or comments. When participating in interactive aspects of the services, please do include all relevant information in a concise manner to help us provide you with a helpful response.

b) Please note that:

2. You understand and agree that wealthup.me may (but is not obligated to) review and delete any Posted Information that in the sole judgment of wealthup.me violates these Terms or which might be offensive, illegal, or that might violate the rights of, harm, or threaten the safety of other users of the Platform and/or any other person;
6. You agree that you will only provide Posted Information that you believe to be true and you will not purposely provide false or misleading information; and The following is a non-exhaustive illustrative list of the kind of content and communications that are illegal or prohibited on/through the Platform or the Website. wealthup.me reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Services and terminating the membership of such violators or blocking your use of the Services and/or the Platform. You may not post content that:

c) You agree, through your use of the Wealthup.me and its Service, that you will not use the Platform to post any material which known to be unlawful, false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, libellous, harmful, obscene, profane, sexually oriented, threatening, racially offensive, invasive of a person's privacy, or otherwise objectionable material of any kind or nature. You agree not to post any copyrighted material unless the copyright is owned by you or you have been given permission by the copyright owner to post such material and you give due credit to the copyright owner by including the copyright information in your post.

d) You agree and acknowledge that you will not submit unlawful, offensive, inaccurate, misleading, abusive, pornographic, harassing, libellous, blasphemous, defamatory, obscene, paedophilic, invasive of another's privacy, hateful, racially or ethically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise inappropriate material.

e) You also agree that you will:

2. Obtain any consents, permission or licenses that may be legally required for you to submit any material;
3. Respect the privacy of others;
4. Not distribute or post spam, unreasonably large files, chain letters, pyramid schemes, viruses;
5. Not use any other technologies or initiate other activities that may harm the Service, or the interest or property of the Users; and
6. Not use any automated systems or means to access, acquire, copy or monitor any part of the Service.

f) You will notify wealthup.me at upon coming across any objectionable content on the Website/Platform and wealthup.me shall use best efforts to remove such objectionable content in accordance with applicable laws, if any.

a) All trademarks, brands and service marks used in conjunction with the services offered by wealthup.me and owned by wealthup.me shall be our property; wealthup.me shall own all of the copyrights and database rights in the Services. Without our consent, you may not publish, distribute, extract or reproduce any contents provided by the services. For use of any third party's intellectual property, you need to get permission directly from the owner of the intellectual property for any use. Third party trademarks may appear on this Website or the Platform and all rights therein are reserved to the registered owners of those trademarks.

b) As a user of our Platform, you acknowledge that any intellectual property which is not specifically mentioned to be owned by us is owned by their respective owners and the owners have a right to take appropriate actions against you for any violation, infringement and passing off.

d) It is reiterated that all content included on the Platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of wealthup.me, its affiliates or its content suppliers and is inter-alia protected by Indian and international copyright, authors' rights and database right laws.

e) You cannot systematically extract or re-utilise parts of the contents of the Platform without wealthup.me’s and / or its affiliate's (as may be applicable) express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this website, without wealthup.me’s and / or its affiliate's (as may be applicable) express written consent. You may also not create and/ or publish your own database that features substantial (e.g.: prices and product listings) parts of this website without wealthup.me’s and / or its affiliate's (as may be applicable) express written consent.

a) The Services may include links to other websites. Some of these websites may contain materials that are objectionable, unlawful, or inaccurate. These links are provided for your convenience only and the provision of these links does not mean that we endorse these websites or the products and services they provide. You acknowledge and agree that we are not responsible or liable for the content or accuracy of these other websites.

b) You will note that the URL to every webpage on our Platform or Website begins with "https://". In other words, every webpage on our Website is hypertext transfer protocol secure ("HTTPS Enabled") or "identity verified".

c) Our entire Website HTTPS Enabled to better protect your security against dummy websites. Please verify that a webpage is HTTPS Enabled before providing any information on it. We will not be liable for any consequences of you providing details on any third party website, including dummy websites.

d) wealthup.me shall not liable for any loss arising out of transfer to the secured and registered payment gateway of wealthup.me. You undertake the risk of any loss (including financial loss) which may arise due to such transfer to the registered payment gateway of wealthup.me.

e) User shall notify wealthup.me in case of payment failure to a merchant/vendor. wealthup.me shall reimburse the amount of payment failure once it receives the amount from its registered third-party Payment and Settlement System Merchant.

a) The Platform/interface is provided subject to all of the terms set forth in the Conditions of Use.

b) wealthup.me disclaims all warranties whether express or implied, including but not limited to:

1. That our Platform will always function without disruptions, delay or errors. A number of factors may impact the quality of your communications and use of the Platform and may result in the failure of your communications including but not limited to: your local network, firewall, your internet service provider, the public internet, the public switched mobile network, private switched mobile networks and your power supply. We take no responsibility for any disruption, interruption or delay caused by any failure of or inadequacy in any of these items or any other items over which we have no control;
2. Your ability to use the Service through the Platform;
3. Your satisfaction with the Service or the Platform;
4. Security and privacy of your data despite wealthup.me’s efforts to maintain its sanctity, security and privacy;
5. That bugs or errors in the Service and/or Platform will be corrected; That our Services will be compatible with all broadband services and modems and we disclaim any express or implied warranties regarding the compatibility of our Service with any particular broadband service or modems;

c) We make no express or implied representations or warranties about our Services or the Platform and disclaim any implied warranties, including, but not limited to, warranties or implied warranties of merchantability or fitness for a particular purpose or use or non-infringement. We do not authorize anyone to make a warranty on our behalf and you may not rely on any statement of warranty as a warranty by us; and That our team who furnishes Services to you in connection with this Agreement or the Service will not be liable for any act or omission in relation to the Platform.

In addition to all Terms of this Agreement, you shall not:

1. Use the third party links to sites without agreeing to their website terms & conditions;
2. Post links to third party websites or use their logo, company name, etc. without their prior written permission; or
3. Use the Services for spamming and other illegal purposes.

a) Your account may be disabled and Services may be terminated based upon the representations made by you. Any of the following actions may result in termination of Services:

1. Impersonating another person or entity with the effect of misleading users about the identity of the creator of content (including misleading account user names, voices and sounds used in broadcasts, and account profile information);
2. Impersonating the Services or a wealthup.me Team member;
3. Representing that content you post or transmit through the Services is created or endorsed by us;
4. Providing or sending any content which may be harmful or detrimental to wealthup.me or its business associates, or which violates any restriction or policy established by wealthup.me or its business associates;
5. Submission of any content that falsely expresses or implies that such content is sponsored or endorsed by us;
6. Falsification or deletion of any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is posted;
7. Putting on wealthup.me's system any content that contains software viruses, trojan horses or any other computer code, files, or programs designed to interrupt, destroy, or limit functionality of any computer software or hardware or telecommunications equipment;
8. Manipulating Service identifiers in order to disguise the origin of any content transmitted via the Services;
9. Collecting or storing personal data about other users;
10. Interfering with or disrupting the Service or servers or networks connected to the Service, or disobeying any requirements, procedures, policies or regulations of networks connected to the Service;
11. Using any robot, spider, website search/retrieval application, or other device to retrieve or index any portion of the Service or collect information about users for any unauthorized purpose; or
12. Creating user accounts by automated means or under false or fraudulent pretences. Any other act which my prejudice the Services and/or Platform or any other activity of wealthup.me

b) wealthup.me, in its sole discretion, reserves the right to remove any user for using the Platform in any way it is not intended to be used or as otherwise required by wealthup.me.

You may not use contact information provided by us or other users or harvest such information for the purpose of sending, or to facilitate the sending, of unsolicited bulk communications such as spam. You may not allow others to use your account to violate the terms of this section. We may terminate your membership or access to the Service and/or Platform immediately and take other legal action if you or anyone using your credentials violates these provisions.

Certain Services on the Platform may have additional terms (such as policies, guidelines, and rules) that will further govern your use of that particular Service and supplement these Conditions of Use. If you choose to register for or access any such Services, you will be presented with any relevant additional terms and conditions at that time. a) You agree that wealthup.me may modify this agreement at any time, effective immediately, by posting a new agreement. You agree that even if you have not personally visited the website with the new terms of this agreement, that they may have force immediately.

b) The Service and the Website and its entire contents are provided on an 'as is' basis. wealthup.me and its officers, employees, agents and contractors give or make no representation or warranty (either express or implied) as to the suitability of the Service or the Platform or its contents for any purpose or the completeness, accuracy, reliability, security or availability of the Service or the Platform or its contents; nor do they accept any responsibility arising in any way (including from negligence) for errors in, or omissions from, the Service or the Platform or the Website.

c) wealthup.me and its officers, employees, agents and contractors are not liable for any loss, damage, claim, expense, cost (including legal costs) or liability arising directly or indirectly from your use or non-use of the Service or the Platform, or your reliance upon the Service/Platform or the information contained upon the Service/ Platform (whether arising from wealthup.me's or any other person's negligence or otherwise).

d) You and wealthup.me agree that any cause of action arising out of your use of the Service or Platform must be commenced within 12 (twelve) months after the cause of action accrues or you become aware of the facts giving rise to the cause of action, whichever is later. Otherwise, such cause of action is permanently barred. Where any legislation implies any term, condition, representation or warranty into these Conditions or the Privacy Policy and that legislation prohibits exclusion of that term, condition, representation or warranty, then that term, condition, representation or warranty is included.

a) Your sole and exclusive remedy for any dispute with us is the suspension of your wealthup.me account. In no event shall our total cumulative liability to you for any and all claims relating to or arising out of your use of the Platform, regardless of the form of action, exceed INR 500 /- (Indian Rupees FIVE HUNDRED only).

b) In no event shall we be liable to you (or to any third party claiming under or through you) for any indirect, special, incidental, consequential or exemplary damages arising from your use of, or inability to use, the Platform. These exclusions apply to any claims for lost profits, lost data, loss of goodwill, work stoppage, computer failure or malfunction, any other commercial damages or losses, even if we knew or should have known of the possibility of such damages.

c) You agree to defend, indemnify and hold wealthup.me, and its Team harmless from and against any claims, actions, demands, liabilities, judgments, and settlements, including without limitation, reasonable legal fees resulting from or alleged to result from your use of this Platform.

You hereby indemnify and hold wealthup.me, and its team harmless from any loss, costs, damages, expenses, and liability caused by your use of the Platform or third-party use of your Account/Platform, your action/inaction due to any misrepresentation made by anyone except wealthup.me, your violation of the Conditions of Use, or your violation of any rights of a third party through use of the Platform.

By using our Platform, you consent to receiving communications from us electronically. We may communicate with you by email, push notifications (on the Platform) and SMS. You agree that all electronic agreements, notices, disclosures and other communications satisfy any requirements under applicable law(s) and that such communications are in writing. Our emails to you will be sent to the email address you last provided us, that is, if you shared your email address with us through the Platform. We will assume that you have received the email once it is sent from the outbox of our email address.

a) If due to any Act of God, Riot, war, blockade, embargo, flood, explosion, fire or earthquake, inevitable accident, epidemics/pandemics, legal and governmental restrictions like lockdowns, communications including internet and server failure, then wealthup.me shall be excused from performing, during the subsistence of the Force Majeure conditions, the acts it is unable to perform. However, no cause of action of any kind shall accrue to you and/or against wealthup.me during the currency or post expiry of the Force Majeure event.

a) wealthup.me controls and operates the Platform and Services and makes no representation that the contents and Services are appropriate or available for use in other locations. If you use the Services or Platform from a location other than the location where the Platform and Services are controlled and operated, you are responsible for compliance with applicable local laws.

b) The Conditions of Use shall be governed by and construed in accordance with the laws of India. Courts or tribunals at Bangalore, India shall have exclusive jurisdiction over all disputes.

a) Assignment: You shall not assign or transfer any right or obligation that has accrued to you under these Conditions, and any attempt by you to assign or transfer such rights and obligations, shall be null and void. We may assign or transfer any right or obligations that accrued in our favour, at our sole discretion, without any restriction.

b) Waiver: Unless otherwise stated expressly, any delay or failure in our exercising any rights/remedies arising out of these Terms and/or other policies available on the Platform, shall not constitute a waiver of rights or remedies and no single/partial exercise of any rights or remedies, hereunder, shall prevent any further exercise of the rights/remedies by us.

c) Survival: You acknowledge that your representations, undertakings, and warranties and the clauses relating to indemnities, limitation of liability, warranties, governing law shall survive the efflux of time and the termination of these Conditions.

d) Severability: If any provision of these Conditions is held illegal or unenforceable, the validity, legality and enforceability of the remaining provisions contained herein shall not in any way be affected or impaired thereby. Any such provision held invalid, illegal or unenforceable shall be substituted by a provision of similar import reflecting the original intent of the parties to the extent permissible under applicable law.
